By accessing or using our Site, and by purchasing products from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.

2. Definitions

Term Definition
“Site” The website located at https://electricalmarinesolutions.pl
“Products” Marine engines, outboard motors, and related goods offered for sale on the Site
“Customer” Any individual or entity that purchases Products from the Company
“Order” A request by a Customer to purchase Products from the Company
“Parties” Collectively, the Company and the Customer

3. Eligibility

By using our Site and placing Orders, you represent and warrant that:

  • You are at least 18 years of age

  • You have the legal capacity to enter into a binding contract

  • You are not located in a jurisdiction where the purchase of our Products is prohibited by law

  • All information you provide to us is accurate, current, and complete

4. Products and Pricing

4.1 Product Descriptions

We strive to provide accurate descriptions of all Products on our Site. However, we do not warrant that product descriptions, specifications, images, or other content are error-free, complete, or current. If a Product offered by us does not match the description, your sole remedy is to return it in accordance with our Return Policy.

4.2 Pricing

All prices listed on the Site are in Polish Złoty (PLN) and are exclusive of shipping, handling, and applicable taxes unless otherwise stated.

  • VAT: Prices include Polish VAT at the applicable rate (currently 23%) unless a valid EU VAT number is provided for intra-community supply.

  • Shipping: Shipping costs are calculated at checkout and are the responsibility of the Customer unless otherwise agreed.

  • Price Changes: We reserve the right to change prices at any time without prior notice. Prices in effect at the time of Order placement will apply.

4.3 Availability

Product availability is subject to change without notice. We reserve the right to:

  • Limit quantities available for purchase

  • Discontinue any Product at any time

  • Reject or cancel any Order for any reason, including product unavailability or pricing errors

5. Orders and Acceptance

5.1 Placing an Order

To place an Order, you must:

  1. Add Products to your shopping cart

  2. Provide accurate shipping and billing information

  3. Review and confirm your Order

  4. Submit payment

5.2 Order Confirmation

After placing an Order, you will receive an email acknowledging receipt of your Order. This email is not an acceptance of your Order. It is confirmation that we have received it.

5.3 Order Acceptance

We reserve the right to accept or reject any Order for any reason. Acceptance of your Order occurs when we:

  • Send you a confirmation email that your Order has been processed and shipped, OR

  • Otherwise expressly confirm acceptance in writing

If we reject your Order, we will notify you and issue a full refund for any payment received.

5.4 Order Cancellation

You may cancel your Order within 14 days of receipt in accordance with Polish consumer protection laws (see Section 12). Orders may not be canceled after dispatch without incurring return shipping costs.

6. Payment Terms

6.1 Accepted Payment Methods

We accept the following payment methods:

  • Bank transfer (advance payment)

  • Other payment methods as displayed at checkout

6.2 Payment Processing

Payment must be received in full before Products are shipped, unless alternative arrangements have been made in writing. If payment is not received, we reserve the right to cancel your Order.

6.3 Secure Transactions

We use industry-standard encryption and security measures to protect your payment information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

7. Shipping and Delivery

7.1 Shipping Methods

We ship Products via reputable carriers. Shipping methods and estimated delivery times are provided at checkout.

7.2 Delivery Timeframes

Estimated delivery times are provided in good faith but are not guaranteed. We are not liable for delays caused by:

  • Carrier issues or delays

  • Customs clearance

  • Weather events or natural disasters

  • Manufacturer backorders

  • Any other circumstances beyond our reasonable control

7.3 Risk of Loss

Title and risk of loss pass to the Customer upon delivery to the carrier. For damaged shipments, please refer to Section 9.

7.4 International Shipping

For shipments outside Poland:

  • Customers are responsible for any import duties, taxes, or customs clearance fees

  • We are not responsible for delays caused by customs processing

  • Customers are responsible for ensuring that Products comply with local laws and regulations

8. Manufacturer Warranties

All Products sold by Electrical Marine Solutions sp. z o.o. are covered by the manufacturer’s warranty, not by any warranty from the Company unless expressly stated in writing.

8.1 Cummins Engines

Cummins marine engines are warranted by Cummins Inc. in accordance with their standard warranty terms and conditions. Warranty coverage, duration, and claim procedures are as set forth in the documentation provided with the Product.

8.2 Evinrude Outboard Motors

Evinrude outboard motors are warranted by BRP Inc. in accordance with their standard warranty terms and conditions. Warranty coverage, duration, and claim procedures are as set forth in the documentation provided with the Product.

8.3 Warranty Claims

For warranty claims, Customers must:

  1. Retain all original documentation, including purchase receipts

  2. Contact the manufacturer or an authorized service center directly

  3. Follow the manufacturer’s warranty claim procedures

We assist in facilitating warranty inquiries but are not responsible for manufacturer warranty administration or coverage decisions.

9. Returns and Refunds

9.1 Right of Withdrawal (Consumer Rights)

If you are a consumer (private individual) purchasing Products for purposes outside your trade, business, or profession, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with Polish consumer protection laws (Ustawa o prawach konsumenta).

Withdrawal Period: 14 days from the date on which you acquire physical possession of the Product.

How to Withdraw:

  1. Notify us of your decision to withdraw by sending an email to help-desk@electricalmarinesolutions.pl

  2. Return the Product to us at your own cost, unless the Product is defective or we agree otherwise

  3. Products must be returned in their original condition, unused, and with all original packaging and documentation

Refund: We will refund the full purchase price (excluding original shipping costs) within 14 days of receiving the returned Product or proof of return shipment.

9.2 Defective Products

If a Product is defective or does not conform to the contract, you are entitled to legal remedies under Polish law. Please contact us immediately at help-desk@electricalmarinesolutions.pl with:

  • Your Order number

  • Description of the defect

  • Photographs or video evidence, if applicable

9.3 Exceptions to Returns

The following Products are not eligible for return or withdrawal:

  • Products that have been installed, used, or modified

  • Products that are custom-ordered or specially procured for the Customer

  • Products where the original packaging has been significantly damaged or is missing

  • Products that are clearly identified as “non-returnable” at the time of purchase

10. Intellectual Property

All content on this Site, including but not limited to:

  • Text, articles, and blog posts

  • Product descriptions

  • Images, photographs, and graphics

  • Logos, trademarks, and trade names

  • Website design, layout, and structure

  • Source code and underlying software

is the property of Electrical Marine Solutions sp. z o.o. or its licensors and is protected by Polish and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content on this Site without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Electrical Marine Solutions sp. z o.o., its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Your use of or inability to use the Site

  • The purchase, installation, or use of any Product

  • Any technical advice or information obtained from the Site

  • Any delay or failure to perform due to circumstances beyond our reasonable control

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.

Total Liability: In any event, our total liability to you for all claims arising out of or relating to these Terms or your purchase of Products shall not exceed the amount paid by you for the specific Product giving rise to the claim.

You agree to indemnify, defend, and hold harmless Electrical Marine Solutions sp. z o.o., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • Your use of the Site in violation of these Terms

  • Your violation of any applicable laws or regulations

  • Any installation, modification, or improper use of Products purchased through the Site

  • Your violation of any third-party rights

13. Privacy and Data Protection

Your use of the Site and our collection and processing of your personal data is governed by our Privacy Policy. By using the Site, you consent to such processing and warrant that all data you provide is accurate.

  • Supply chain disruptions or manufacturer production delays

  • Government regulations, embargoes, or import/export restrictions

  • Pandemics, epidemics, or public health emergencies

  • Power outages, telecommunications failures, or cyberattacks

If a force majeure event occurs, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume performance as soon as practicable.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from or relating to these Terms or your purchase of Products shall be subject to the exclusive jurisdiction of the courts of Gdańsk, Poland.
